Ich möchte euch diese Email vorstellen und jeden bitten, einen kurzen Brief zu schreiben. Er wird dann als Fax an die zuständige Kommission gefaxt. Es geht darum, daß Italien die USA gebeten hat, die strengen italienischen Gesetze für Kulturgüter zu übernehmen. Auch für antike Münzen! Das bedeutet, daß jede Münze, von der man nicht nachweisen kann, daß sie nicht aus Italien stammt, beschlagnahmt werden kann. Sollten die USA der Bitte nachkommen, hätte das einen erheblichen Nachteil für unser Hobby. Insbesondere wird der Handel mit antiken erheblich erschwert werden. Mit Sicherheit würde das zu einem Preisanstieg führen und man wäre ständig mit einem Bein im Gefängnis.

I wanted to update everyone on the Italian import restrictions hearings which will end this Wednesday. The fax wizard has been reconfigured so that you can send your comments even if you are not a US resident! I have already received many emails from friends who have taken a few minutes and sent their electronic fax opposing the looming import restrictions on Ancient Roman coins! I have also had friends in both Canada and Australia successfully use the fax wizard!

Wednesday August 24th is the final day to make you voice heard and at last count only 401 faxes have been sent!

Everyone reading this message should understand that there is a VERY REAL threat that renewal of the Italian MOU may add ancient coins to the list of items that would be prohibited from import into the US. The impact on the worldwide market for ancient coins would be very serious.

It is relatively easy to prevent import restrictions now. Think for a moment of the outrage you would feel should anticollecting radicals succeed in stopping international commerce in ancient coins. Ancient coins would become much more difficult and expensive to obtain. Collections, paradoxically, would also become more difficult to sell. Your favorite dealers would be forced out of business because they could not get coins to offer.

Please take a few minutes now to protect your freedoms and don't let this happen.

Der Adressat ist ein Ausschuss des amerikanischen Kongresses, wenn ich mich nicht täusche. Ich denke, dass Appelle von ausländischen Personen bzgl. amerikanischer Gesetze oder Verordnungen als Einmischung in innere Angelegenheiten angesehen werden und einfach nicht beachtet werden.
So sehr ich mit den amerikanischen Sammlerfreunden auch mitfühle, Ausländer dürften zu soetwas wohl nicht das Recht haben.

Stellt Euch vor, die Bundesregierung will ein generelles Tempolimit auf deutschen Autobahnen beschliessen und ausländische Autofahrer protestieren bei deutschen Abgeordneten dagegen.

Was uns in Deutschland eher Sorgen machen sollte, wäre die Ratifizierung des UNESCO Kulturabkommens ohne Berücksichtigung der Interessen deutscher Münzensammler.
(Ich glaube, dazu gibt es bereits Threads)

Jede Restriktion kann immer nur so wirksam sein wie die zu ihrer Durchsetzung durchgeführte Kontrolle. Eine solche über den Handel mit antiken Münzen ausüben zu wollen, würde die Behörden schon aus Kostengründen vor unlösbare personelle (u. a. Sachverstand!) und organisatorische Probleme stellen, ganz abgesehen von einem zu erwartenden erbitterten Widerstand der organisierten Sammler und Händler.
Niemand kann zwar etwas dagegen haben, wenn der freie Handel mit Raubgrabungsfunden und archäologisch oder kulturgeschichtlich bedeutsamen und vielleicht einmaligen Antiken unterbunden wird, aber diese Maßnahmen sogar auf die massenhaft vorkommenden Münzen auszudehnen heißt, das Kind mit dem Bade auszuschütten. Es kann ebenfalls niemand ein Interesse daran haben, Zigtausende seriöser Sammler und Händler in die Illegalität abzudrängen und dafür das Feld mafiösen Dealern zu überlassen, die ganz gewiß das entstandene Vakuum mit Freuden ausfüllen würden. Die Amerikaner sollten sich, bevor sie dem Ansinnen der Italiener stattgeben, in diesem Zusammenhang nur mal an die Prohibition erinnern, die nicht zu dem gewünschten Rückgang des Alkoholkonsums, wohl aber zu einer massiven Stärkung des organisierten Verbrechens geführt hat.
Dennoch könnte es ratsam sein, sich in münzinteressierten Kreisen schon im Vorfeld über wirksame Aktionen zu verständigen und vor allem die nicht betroffene und deshalb uninformierte Öffentlichkeit über die unsinnigen Pläne einer amoklaufenden Bürokratie in Kenntnis zu setzen. Es geht hier schließlich um grundlegende Freiheitsrechte aller Bürger.

P.S. Es fragt sich, ob nach unseren Gesetzen Beweislast (die Münze kommt nicht aus Italien) dem Besitzer aufgebürdet werden kann, oder ob nicht vielmehr die Italiener nachweisen müßten, daß sie tatsächlich aus ihrem Land stammt. Beide Beweise sind wohl kaum zu erbringen, und damit zeigt sich, wie absurd das Ganze ist.

ich denke nicht, dass der US-Kongress allein auf Betreiben der italienischen Regierung so mir nichts dir nichts ein Einfuhrverbot für alle antiken Münzen beschließen wird. Das wäre wirklich etwas zu viel des Guten. In den USA, die ja den freien Handel quasi wie eine Monstranz vor sich her tragen, dürfte das nicht so leicht umzusetzen sein, wie schon der erste Protestaufruf der Interessengruppen zeigt.

Wie chinamul schon ausführte, sollte man auch nicht das Kind mit dem Bade ausschütten, denn eine Differenzierung tut bitter Not. Antike Kulturgüter von überragendem öffentlichen Interesse -in unserem Fall eine römische Münze mit historischer Aussage, die es vielleicht nur einmal gibt- gehören nicht in Sammlerhände. Nicht etwa weil die Leute das Ding schlecht behandeln würden, sondern weil solch eine Münze einfach in ein Museum gehört, wo die Öffentlichkeit sie besichtigen kann. Anders ist es bei Münzen, die es in Massen gibt und die ich für 5 Euro bei eBay ersteigern kann. Hier wäre ein Verbot unsinnig, kaum durchführbar und letztlich unverhältnismäßig. Niemand hat ein Interesse an einem Verbot dieses Handels - auch Italien und Griechenland nicht, denn deren Museumsmagazine sind ohnehin überfüllt.

soweit ich weiss, haben die italiener letztes jahr ihre sehr strengen ausfuhrgesetze für antike fundstücke dahingehend geändert, dass gängige antike münzen nicht mehr darunter fallen, und jetzt sogar ohne ausfuhrgenehmigung verkauft werden dürfen.
sogesehen ist die angst der amerikanischen sammler etwas übertrieben.
allerdings steht tatsächlich zu befürchten, dass in zukunft mit der ratifizierung verschiedener unesco-abkommen, probleme beim sammeln antiker münzen auftauchen könnten.
sicher eine sache die beobachtet werden muss, um gegebenenfalls aktionen zu starten soetwas vielleicht zu verhindern

Ich fahre nicht mit dem Auto in die USA, kaufe aber sehr wohl Münzen in den Staaten. Münzhandel ist global und die USA (bzw. US-Händler) gehören auch hier zu den federführenden Akteuren; zu glauben, ein solches Gesetz würde den europäischen Münzhandel bzw. europäische Sammler nicht betreffen, erachte ich als etwas zu optimistisch... die Aktion wurde zudem, wenn ich das richtig sehe, von vcoins gestartet, einem internationalen Zusammenschluss von Münzhändlern.

die Aktion wurde auch von mindestens einer weiteren Organisation in den USA gestartet (National Coin Collector´s Guild oder so ähnlich), wobei die dort organisierten Mitglieder auch teilweise Händler sind, die über VCoins verkaufen.
So groß ist die Gemeinde ja nicht.

Ich denke natürlich auch, dass so eine Entscheidung Einfluss auf den Münzenhandel weltweit hätte, wie immer der aussehen mag.

Mein Punkt war: es geht um ein nationales amerikanisches Gesetz und fällt unter amerikanisches Recht.

Ausländische Privatpersonen/Firmen/Organisationen haben kein Recht, darauf Einfluß zu nehmen.
Jedes Land dürfte es sich wohl verbitten, dass Ausländer auf nationale Gesetzgebung Einfluss nehmen wollen. Das sollte mein Beispiel mit dem Tempolimit verdeutlichen.

Die UNESCO versucht ja gerade, internationale Regelungen für die unterschreibenden Länder verbindlich zu machen.
Aber wie gesagt, hier handelt es sich um nationales Recht.

Es spielt dabei keine Rolle, ob VCoins international tätig ist oder ob Ausländer in den USA Münzen kaufen (oder nicht dorthin mit Auto fahren ).

Es gibt viele globale Märkte. Dennoch werden die Regeln oft national erstellt. Man sehe sich nur die Türkei an. Dort müssen Münzensammlungen z.B. gemeldet sein! Sollten wir bei der türkischen Regierung dagegen protestieren?

Ich verstehe schon, was du meinst, aber mal ehrlich: kümmern sich die Amis je um Gesetze anderer Länder? Die mischen sich auch andauernd überall ein, da habe ich keine Hemmungen, auch mal ihre Gesetze zu kritisieren! Obs was nützt ist eine andere Frage, klar, aber ich glaube daran, dass man seine Stimme erheben sollte, wenn einem etwas nicht passt.

PS: ich habe mal auf RTL2 eine "Dokumentation" mit dem Titel "Die Urlaubsabzocker" gesehen, in der es um die angeblich zu hohen Schweizer Bussen für zu schnelles Fahren auf dem Autobahnnetz ging. Da wurde der Schweizer Botschafter auch nicht in Berlin vorstellig

Natürlich habe ich das Recht, darauf Einfluß zu nehmen!
Wie groß dieser Einfluß ist und wie erfolgreich ich damit bin, ist eine andere Frage.

Das ist mal wieder typisch deutsch! Anstatt zu handeln kommen nur Einwände, Bedenken und Kritik! Ich werde an die Zeit erinnert, wo meine Kinder noch zur Schule gingen und wir Elternversammlungen hatten, weil ein Klassenfest organisiert werden sollte. Furchtbar, kann ich nur sagen!

1) Antoninus, Vcoins hat auch alle nicht-amerikanischen Sammler
gebeten, sich an dieser Aktion zu beteiligen.
2) Chinamul, es gibt kein Vorfeld mehr, sondern morgen, Mittwoch, soll
darüber beschlossen werden.
3) Mit den illegalen Strukturen wird es dann wohl Wirklichkeit werden. Der
Hinweis auf die Prohibition finde ich ganz richtig!
4) Mit der Beweislast ist das aber so eine Sache, Chinamul. Hast Du
schon mal versucht mit einem italienischen Carabinieri darüber zu
diskutieren?
5) Scharfnasius, die meisten Münzen in den Museen liegen unbestimmt im
Keller und werden auch nicht besser. Und oft werden sie zur
Bestimmung bis aufs Metall gereinigt, ein Graus für jeden Sammler!
6) Beachcomber, die Zeit zu beobachten ist vorüber! Die Aktion sollte
heute noch gestartet werden!

Hier habe ich einmal den Brief, den ich gestern geschrieben habe:

I'm living in Germany and I'm not a citizen of the USA. But I am deeply bewildered about the consequences of the MOU. I collect ancient coins about 10 years. My foreign coin dealers are mainly US coin shops from Vcoins who has a special ethical agreement. The renewal of the MOU would be a disastrous impact on my hobby. I ask myself what positive results do you think the new MOU would have.

1. First of all I want to say that I do respect the cultural heir of every nation in the world. What I have heard about the Vandalism in Bagdad with the rupture and destroying of world heritage has filled my heart with horror and deep mourning. To avoid such events and to punish their actors that should be the aim of every civilizated nation!

2. I know that trading with ancient coins in Italy is very restrictive. I think how Italy handles its laws is not legal at all. To consider all ancient coins as cultural heir of Italy - as Italy do! - is against all historical facts. My coins are from Arles, Lyon, Trier, London, Siscia and so on. That are Roman coins, but not at all Italian! If every country in the world would act in the same manner then the cultural communication - one of the most important influences for world peace - would be disrupted!

3. Trading with coins would be pushed away to illegality as you can learn from prohibition. I think it is not possible to cut off trading with ancient coins but the prizes will increase.

4. Therefore I ask the responsible men and women: Please don't subscribe the renewal of the MOU!

Today the US State Department imposed restrictions on importation of ancient
coins "of Cypriot types" issued prior to 330 a.d

Anyone importing coins of "Cypriot" types (or anything remotely similar) may
find them detained by Customs, which now has broad discretion to detain any
coin that looks “Cypriot” (the restrictions state “including, but not
limited to” the types listed—the designated list is illustrative not
definitive). Importers of many different types of non-Cypriot coins may be
at risk, because most Customs officials cannot distinguish one ancient coin
from another, and the new regulations provide almost no practically useful
guidance.

Detained coins will be sent to a bonded warehouse to be held at the risk and
expense of the importer (which could be financially onerous even if the
coins are recovered), until satisfactory documentation or evidence is filed
with the Customs officer. The burden will then fall upon the importer to
produce either an export certificate issued by the Cypriot Government, or
certifications from both exporter and importer declaring that the coin in
question was out of Cyprus as of July 13, 2007. If satisfactory
documentation or evidence is not presented within ninety days after the date
of detention, the coins would be subject to seizure and forfeiture.

It may not be easy to get such a declaration in proper form from an
exporter, and the importer would also be at the mercy of Customs as to
whether the declarations were deemed sufficient. In the ordinary course of
numismatic business, neither exporter nor importer are likely to know where
a coin was at any particular past date, because coins are so common and
have such low value that this information is normally not worth documenting.
Thus, many coins which “look Cypriot,” but were never in Cyprus since
ancient times, will probably be seized and sent to Cyprus for lack of
documentation.

IMPORT RESTRICTIONS.

This regulatory action impacts all collectors of ancient coins, and dealers
and auction houses who supply them. The restrictions announced today are
expected to be a significant problem in themselves, and worse could follow
because there is now a regulatory precedent for imposing import restrictions
on coins. It may not take very many additional import restrictions of this
type to make importing ancient coins into the USA so complicated and onerous
that few will go through the difficulties of importing them.

The breadth of the threat to private collecting extends far beyond ancient
coins. Most types of collectibles more than 100 years old are included in
the scope of the 1970 UNESCO Convention, and the CPIA statute that
implemented it in the USA. Collectors of medieval and world coins, foreign
postage stamps and banknotes, and antiquarian books may one day find
themselves facing preservationist efforts to impose similar import
restrictions.

Cyprus has been revised and is published below. We note that the subcategory
Coins of Cypriot Types has been added to the category entitled Metal,
pursuant to 19 U.S.C. 2604. This addition comes in response to a request
from the Government of the Republic of Cyprus to amend the Designated List.

Coins constitute an inseparable part of the archaeological record of the
island, and, like other archaeological objects, they are vulnerable to
pillage and illicit export.
